1. I won't give you a hard time if you request a refund within the first 7 days after purchase. You will get your money back, no questions asked.

2. As for practicum, observation, and consultations, you can reschedule them, at least 24 hours before the event. If you come from a different location and the practicum sessions are all-day commitments, please cancel at least 7 days beforehand.

 

3. There are no guarantees for any results and I won't take responsibility for any of your choices and mistakes. Malpractice Insurance is NOT included outside of the course. 

 

4. This is an educational course - you are responsible for your own progress and I will deliver all my knowledge above & beyond. You will get all the practical, hands-on clinical practice you need to be a confident and competent Aesthetics Professional.

 

5. I will keep your info safe and you will respect our intellectual property rights - and you will do the same.

Terms Of Service

 

Please read carefully. By purchasing the InHer Beauty Aesthetics Lasers & Injectables Course you (herein referred to as “Student”) agree to the following terms stated herein.

 

SERVICE

Melissa Duran (herein referred to as Trainer or Service Provider) agrees to provide the Aging Gracefully With Aesthetics Course (herein referred to as “Course”) identified in the online commerce shopping cart. Student agrees to abide by all policies and procedures as outlined in this agreement as a condition of their participation in the Course.

 

DISCLAIMER

 

Melissa Duran (herein referred to as “Trainer” or "Service Provider") is not an employee, agent, lawyer, doctor, manager, therapist, public relations or business manager, registered dietician, or financial analyst, psychotherapist, or accountant. Student understands that Trainer has not promised, shall not be obligated to and will not; (1) procure or attempt to procure definite Aesthetics results for Student; (2) perform any management functions including but not limited to, accounting, tax or investment consulting, or advice with regard thereto; (3) act as a therapist providing psychoanalysis, psychological counseling or behavioral therapy; (4) act as a healthcare provider providing healthcare services (5) introduce Student to Trainer’s full network of contacts, or refer Student to other providers. Student understands that a relationship does not exist between the parties after the conclusion of this Course. If the Parties continue their relationship, a separate agreement will be entered into.

 

FEES

Price: $9997 if paid in full, $11991 if paid with a payment plan.

The fee must be paid in full prior to the Course or following this payment plan:

3 payments of $3997 every 4 week, starting. The first installment must be paid prior to the Course.

If you are taking the Online/Offline blended version of the Course, you can pay in a 50-50% arrangement:

  • $5000 before starting the Online segment of the course
  • $5000 before booking the in-person Practicum & Observation days

 

REFUND POLICY

 

Money-Back Guarantee:

We want you to be satisfied with your purchase but we also want you to give your best effort to experience some of the game-changing strategies you’ll learn in the Course – therefore we will refund the full sum within the first 7 days upon receiving the first installment or the full payment, should you request it. We also practice the right not to accept any more purchases from the Student who requested a refund.

Notes about our refund policy:

  1. After the first 7 days, you can request a full refund, no questions asked. 
  2.  After 7 days, all payments are non-refundable and you are responsible for full payment of the fees for the Course, regardless if you use the information or not.
  3. All refunds are discretionary as determined by Service Provider. If you download all the materials, take advantage of the special deals/discounts, and then ask for a refund, we reserve the right to deny your request. Why? Our refund policy was built to give people the opportunity to see if the Course is a good fit for their business. Stealing the material is NOT covered under this policy.

To further clarify, we will not provide refunds after the 7th day from your date of purchase.

RESCHEDULING POLICY

 

Note: this policy applies only when the Course Offering includes one or more private one-on-one consultations.

Student receives one free rescheduling option if the Consultation is rescheduled prior to the 24-hour window before the call.

To reschedule, you must do so prior to 24 hours before your Course begins or your payment and one-time complimentary rescheduling will be forfeited.  To reschedule your Course, simply reschedule, send an email to [email protected]. If the Course is canceled within 24 hours before the scheduled start of your call, no refunds are available. 

 

CONFIDENTIALITY

The Service Provider respects Student’s privacy and insists that Student respects Service Provider’s and Student's (herein referred to as “Participants”). Thus, consider this a mutual non-disclosure agreement. Any Confidential Information shared by Students participants or any representative of the Service Provider is confidential, Proprietary, and belongs solely and exclusively to the Student who discloses it. Parties agree not to disclose, reveal or make use of any Confidential Information or any transactions, during discussions, on the forum or otherwise. Student agrees not to use such confidential information in any manner. Confidential Information includes, but is not limited to, information disclosed in connection with this Agreement, and shall not include information rightfully obtained from a third party. Both Parties will keep Confidential Information in the strictest confidence and shall use the best efforts to safeguard the Confidential Information and to protect it against disclosure, misuse, espionage, loss, and theft. Student agrees not to violate the Service Provider’s publicity or privacy rights. Furthermore, Student will NOT reveal any information to a third party obtained in connection with this Agreement or Service Provider's direct or indirect dealings with Student including but not limited to; names, email addresses, third-party Service Provider titles or positions, phone numbers or addresses. Additionally, Trainer will not, at any time, either directly or indirectly, disclose confidential information to any third party. Further, by purchasing this product you agree that if you violate or display any likelihood of violating this Course the Service Provider and/or the other Services participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.

 

NO TRANSFER OF INTELLECTUAL PROPERTY

 

Service Provider’s materials and Course content are copyrighted and original materials that have been provided to Student are for Student’s individual use only and a single-user license. Student is not authorized to use any of Service Provider’s intellectual property for Student’s business purposes. All intellectual property, including Service Provider’s copyrighted Course and/or course materials, shall remain the sole property of the Service Provider. No license to sell or distribute Service Provider’s materials is granted or implied. By purchasing this product, Student agrees (1) not to infringe any copyright, patent, trademark, trade secret, or other intellectual property rights, (2) that any Confidential Information shared by the Service Provider is confidential and proprietary, and belongs solely and exclusively to the Service Provider, (3) Student agrees not to disclose such information to any other person or use it in any manner other than in discussion with the Service Provider. Further, by purchasing this product, Student agrees that if Student violates, or displays any likelihood of violating, any of Student’s agreements contained in this paragraph, the Service Provider will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.

 

STUDENT RESPONSIBILITY

 

Course is developed for strictly educational purposes ONLY. Student accepts and agrees that Student is 100% responsible for their progress and results from the Course. Service Provider makes no representations, warranties or guarantees verbally or in writing. Student understands that because of the nature of the Course and the extent, the results experienced by each Student may significantly vary. Student acknowledges that as with any Aesthetics endeavor, there is an inherent risk, based on the procedures’ risk factors and there is no guarantee that Student will reach their goals as a result of participation in the Course. Course education and information is intended for a Healthcare Professional Audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual. Service Provider assumes no responsibility for errors or omissions that may appear in any Course materials.

 

SEVERABILITY/WAIVER

 

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall nevertheless continue in full force. The failure of either Party to exercise any right provided for herein will not be deemed a waiver of that right or any further rights hereunder.

 

LIMITATION OF LIABILITY 

 

Student agrees they used Service Provider's services at their own risk and that Course is only an educational service being provided. Student releases Service Provider, her officers, employees, directors, subsidiaries, principals, agents, heirs, executors, administrators, successors, assigns, Instructors, guides, staff, Participants, and related entities any way as well as the venue where the Courses are being held (if applicable) and any of its owners, executives, agents, or staff (hereinafter “Releases”) from any and all damages that may result from any claims arising from any agreements, all actions, causes of action, contracts, claims, suits, costs, demands and damages of whatever nature or kind in law or in equity arising from their participation in the Course. Student accepts any and all risks, foreseeable or unforeseeable. Student agrees that Service Provider will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of Service Provider’s services or enrolment in the Course. Service Provider assumes no responsibility for errors or omissions that may appear in any of the Course materials.

 

ASSIGNMENT

 

Student may not assign this Agreement without the expressed written consent of Service Provider.

 

MODIFICATION

 

Service Provider may modify the terms of this agreement at any time. All modifications shall be available to Students and purchasers shall be notified immediately.

 

TERMINATION

 

Service Provider is committed to providing all Students in the Course with a positive Course experience. By purchasing this product, Student agrees that the Service Provider may, at its sole discretion, terminate this Agreement, and limit, suspend, or terminate Student’s participation in the Course without refund if Student becomes disruptive to Service Provider, Student fails to follow the Course guidelines, is difficult to work with, impairs the participation of the other participants in the Course or upon violation of the terms as determined by Service Provider. Student will still be liable to pay the total contract amount.

 

INDEMNIFICATION

 

Student shall defend, indemnify, and hold harmless Service Provider, Service Provider’s officers, employers, employees, contractors, directors, related entities, trustees, affiliates, and successors from and against any and all liabilities and expense whatsoever – including without limitation, claims, damages, judgments, awards, settlements, investigations, costs, attorney’s fees, and disbursements – which any of them may incur or become obligated to pay arising out of or resulting from the offering for sale, the sale, and/or use of the product(s), excluding, however, any such expenses and liabilities which may result from a breach of this Agreement or sole negligence or willful misconduct by Service Provider, or any of its shareholders, trustees, affiliates or successors. Student shall defend Service Provider in any legal actions, regulatory actions, or the like arising from or related to this Agreement. Student recognizes and agrees that all of the Service Provider’s shareholders, trustees, affiliates and successors shall not be held personally responsible or liable for any actions or representations of the Service Provider. In consideration of and as part of my payment for the right to participate in Service Provider’s Courses or other Courses, the undersigned, my heirs, executors, administrators, successors and assigns do hereby release, waive, acquit, discharge, indemnify, defend, hold harmless and forever discharge Service Provider and its subsidiaries, principals, directors, employees, agents, heirs, executors, administrators, successors, and assigns and any of the training instructors, guides, staff or students taking part in the training in any way as well as the venue where the Courses are being held (if applicable) and any of its owners, executives, agents, or staff (hereinafter “Releases”) of and from all actions, causes of action, contracts, claims, suits, costs, demands and damages of whatever nature or kind in law or in equity arising from my participation in the Courses.

Program Information

Program Description

The program consists of ten weeks of training and instruction on providing aesthetic treatments (“Program”). Upon completion of the Program (discussed more fully below), Trainee will receive a certification in ___________. 

The first __ weeks of the Program consist of class instruction.  Class instruction sessions will generally consist ___ days of three (3) hours of educational instruction by Trainer. Classes are limited to no more than ___ trainees during the Program to ensure personalized training and instruction.   Trainees will also complete no less than ____ (hours/days) of observation.  Observation sessions will include personalized instruction and observation of Trainer’s technique on lip treatments, placement of botox and fillers, kybella procedure and technique, consents, tattoo removal, among other topics.  Trainee shall complete no less than __ hours of observation during the Program. Additionally, Trainee will complete six (6) clinical days between the ___ weeks which are approximately __ hours each.  The clinical sessions are held on _____.  Clinical consist of private, in-person trainings with Trainer who instructs on techniques and procedures. 

Cost and Cost Description

The cost for the course is ten thousand dollars ($10,000.00) payable in one lump sum at the time of enrollment (“Enrollment Payment”).  Because courses are in high demand, the Enrollment Payment secures Trainee’s spot in the course in lieu of others who may wish to enroll. The Enrollment Payment also covers Trainee’s share of the rent for use of the training facility during the term of Trainee’s coursework, costs for textbooks, malpractice insurance for Trainee and products (including injectables) and equipment utilized during Trainee’s program paid by Trainer prior to commencement of the Program.  The cost also covers expenses for clerical time associated with administering the Program and for Trainer’s time and expense in formulating Trainee’s coursework.

Note:  Criminal convictions may be may affect a Trainee’s ability to be licensed, registered or certified by the California Board of Nursing.

7-Day Cancellation Period 

Trainee has the right to cancel this Enrollment Agreement including the purchase of books, materials, supplies and any other goods related to the instruction offered in this agreement, if notice of cancellation is made within seven (7) calendar days (excluding holidays) of enrollment (“Cancellation Period”). Any books purchased and delivered to Trainee must be returned to Trainer in “like new” condition within the Cancellation Period, or Trainee will be liable for the full cost of such books and materials.

Cancellation shall occur when the Trainee gives written notice of cancellation at the following address: 1260 South Main Street, Suite 201, Salinas, California 93901.  The written notice of cancellation must communicate Trainee’s explicit intention to cancel this Enrollment Agreement. 

No Refunds After Expiration of Cancellation Period

Should Trainee fail to cancel within the Cancellation Period, the Payment will be nonrefundable.

Leave of Absence

InHer Aesthetics does not grant leaves of absences. 

Graduation Requirements.

Upon successful completion of the program, the Trainee will receive a certificate of completion.

Successful completion requires:

  • Trainee must demonstrate 100% accuracy on all skills taught in the laboratory setting to obtain a “Pass” for this portion of the program.
  • Trainee must demonstrate 100% accuracy on all skills performed in the clinical setting to obtain a “Pass” for this portion of the program.
  • Maintain at least a 86% attendance rate in class.
  • Maintain at least a 80% attendance rate for clinical.

However, any missed clinical time must be made-up. To be eligible for graduation, a trainee must complete 100% of all clinical hours.

  • All Financial obligations to the school are satisfied.

Career/Job Services

InHer Aesthetics does not provide job placement for its graduates.  In addition, InHer Aesthetics cannot guarantee salaries upon graduation.

 

TRAINEE ACKNOWLEDGMENT
